1.General provisions
1.1.This User Agreement (the Agreement) sets the terms for accessing and using the GMTraffic service (the Service) and governs the relationship between the Service Administration and individuals who use the Service.
1.2.The Service Administration grants Users the right to use the Service under a simple non-exclusive license within the limits of its functionality.
1.3.The Service Administration is an information intermediary and is not a party to the offers posted on the Service.
1.4.Using the Service means the User fully and unconditionally accepts this Agreement. A User who does not agree with the Agreement must immediately stop using the Service.
1.5.The laws of the Russian Federation apply to relations between the parties.
2.Terms and definitions
2.1.Service Administration is the owner and administrator of the GMTraffic Service.
2.2.User means an individual registered in the Service and using its functionality to perform offers.
2.3.Author means a Service user who places offers and independently determines their terms.
2.4.Offer means the Author’s proposal for the User to perform a target action under the terms specified in the relevant offer.
2.5.Target action means an action specified in the offer that the User performs outside the Service, in Fortnite.
2.6.Account means the User’s account in the Service.
3.Subject of the agreement
3.1.The Administration provides the User with access to the Service, allowing Users to:
- view offers;
- perform target actions;
- receive information about possible rewards.
3.2.Service Administration:
- does not order target actions;
- does not guarantee that the User will receive rewards;
- is not responsible for the content of offers and actions of the Authors.
3.2.1.The information posted on the Service is not a public offer in the sense of Article 437 of the Civil Code of the Russian Federation.
4.Registration and account
4.1.Use of the Service is possible only after registering an Account.
4.2.Registration is carried out using:
- an email address;
- or a Google account.
4.3.The User must:
- provide accurate information;
- keep access credentials secure;
- not transfer the Account to third parties.
4.3.1.All actions performed using the User Account are considered to be performed by the User.
4.3.2.One User has the right to have only one Account, unless otherwise expressly permitted by the Administration.
4.3.3.The Administration has the right to block or delete the User's Account, including in cases of suspected violation of the terms of the Agreement, fraud or abuse of the functionality of the Service.
5.Offers and targeted actions
5.1.All offer terms, including target action descriptions, deadlines, and reward amounts, are determined by the Authors.
5.2.All target actions are performed by the User outside the Service, in Fortnite.
5.3.The Administration has the right, at its discretion:
- moderate, change, or delete offers;
- suspend access to offers;
- reject the results of performing target actions without giving reasons.
6.Balance and internal settlements
6.1.The Service uses an internal balance accounting system (Balance), intended solely for Service operation and settlements between Users and Offer Authors.
6.2.The balance is a technical accounting tool and is not:
- bank account;
- payment account;
- electronic money;
- means of payment outside the Service.
6.3.Crediting funds to the Balance:
- is not a contribution;
- is not an advance or prepayment for the Administration’s services;
- does not entail the Administration’s obligation to immediately pay such funds.
6.4.Funds are credited:
- By Authors, as the offer budget;
- By Users, as rewards accrued for performing target actions.
7.User Balance
7.1.The reward for performing target actions is credited to the User's Balance only after confirmation of the completion of the corresponding offer.
7.2.Accrual of rewards to the User's Balance does not automatically create a right to withdraw funds.
7.3.Withdrawal of funds from the User's Balance is possible subject to all of the following conditions being met:
- fulfillment of the offer terms;
- no violations of this Agreement;
- passing the required checks (including anti-fraud);
- compliance with the limits and withdrawal deadlines established by the Administration.
8.Adjustment and cancellation of accruals
8.1.The Administration has the right to adjust the Balance of the User and/or the Author in the following cases:
- fraud or abuse is identified;
- the offer terms or Agreement are violated;
- technical calculation errors occur;
- target action results are cancelled or invalidated.
8.1.1.Excess accrued funds may be debited from the User's Balance without prior consent.
8.1.2.In the event of a confirmed violation by the User, the accrued reward will be cancelled.
8.2.The Administration has the right:
- suspend transactions on the User’s or Author’s Balance until the checks are completed;
- change the rules for Balance operation, including limits, terms, and methods of withdrawing funds, by publishing the corresponding changes in the Service.
9.Reward
9.1.Rewards for Users who perform Target Actions are accrued as part of their performance of Offers.
9.2.The User's right to receive rewards arises only if all of the following conditions are met:
- the target action was performed in full accordance with the terms of the offer;
- performance is confirmed in the prescribed manner;
- there are no violations of this Agreement and the terms of the offer.
9.2.1.The Administration has the right to refuse to accrue or pay rewards, including when violations, fraud, abuse, or suspected violations are detected.
9.2.2.The procedure, timelines, and minimum payment amounts are determined by the Administration and may change without prior notice.
9.2.3.The Service withholds a commission of 8% from the rate set by the Author for a target action — the User is credited the amount net of the specified commission. The current commission rate is displayed in the Service interface and may be changed by the Administration unilaterally.
10.Antifraud and violations
10.1.The User is prohibited from:
- creating multiple Accounts;
- using bots, emulators, or other technical means of circumventing restrictions;
- otherwise abusing Service functionality.
10.2.If violations are detected, the Administration has the right:
- cancel the results of targeted actions;
- refuse payment of rewards;
- block or delete the User Account without compensation.
11.Rights and obligations of the parties
11.1.The User must:
- comply with the Agreement;
- perform offers in good faith;
- not violate Fortnite rules or the rights of third parties.
11.2.The Administration has the right:
- change the functionality of the Service;
- limit or terminate the User’s access;
- take any measures to protect the Service and prevent violations.
12.Disclaimer
12.1.The Service is provided “as is”.
12.2.The Administration is not responsible for:
- actions or inactions of the Authors;
- the User being unable to receive rewards;
- the operation of Fortnite and third-party services;
- any indirect losses and lost profits.
12.2.1.The total liability of the Administration for any claims of the User is limited to the amount of rewards actually paid to the User, unless otherwise provided by the laws of the Russian Federation.
12.3.The Administration is not responsible for:
- inability to pay rewards because the offer budget is exhausted;
- actions or inactions of the Author;
- suspension or refusal of payment as part of anti-fraud checks.
13.Intellectual Property
13.1.All elements of the Service, including program code, interface and design, belong to the Administration or are used legally.
13.2.The User is prohibited from copying, modifying, distributing or using elements of the Service without the consent of the Administration.
13.3.Fortnite® is a registered trademark of Epic Games, Inc. All trademarks, service marks, trade names, logos and images related to Fortnite are the property of Epic Games, Inc. GMTraffic is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Epic Games, Inc. The use of the name Fortnite and related materials on the Service is for informational purposes only and does not imply any affiliation or endorsement.
14.Modification and termination of the Agreement
14.1.The Administration has the right to change this Agreement unilaterally at any time.
14.2.The new version of the Agreement takes effect when it is published on the Service.
14.3.Continued use of the Service means the User agrees to the new version of the Agreement.
15.Dispute Resolution
15.1.The pre-trial claim procedure is mandatory. The response period for a claim is 10 business days.
15.2.All disputes are subject to court review at the location of the Service Administration in accordance with the laws of the Russian Federation.
